Bob, am I correct that the Director of Special Education can be the compliance
officer?
We have a number of schools who have gone , or are going, in that direction.
In many districts the Director seems to be the logical person as they have the
necessary training, experience and authority to carry out the responsibilities.

Hi, Joe. SED is directing schools to the OMIG regarding questions on the
Compliance Program. We don't know the details of the new rate methodology, but
we (DOH, OMIG and SED) are working through our networks to provide the latest
updates on the OMIG Compliance Program and the Compliance Agreement (including
the new SPA). SED is sharing with the Regional Information Centers a list,
provided by the OMIG, of districts that could potentially reach $500,000 when
billing resumes. And you are correct that a recent history of claims may not be
reliable predictor of future claims. Each school district will be the best judge
of whether that district expects to reach the threshold or not. And, in my
opinion, whether a school reaches the threshold or not, a Compliance Program
is still a good idea and a good investment. We, as members of the Medicaid in
Education community, must do everything we can to create an environment of
compliance and accountability. An effective Compliance program is one step in
that direction.

We need to make sure all Districts know this. Also they should know that the
"expect" part includes the claims/payments from all years that will be received
in any 12 month period. For example, a school that got $250,000 in gross claims
a year should expect to exceed $500,000 in 2010. All of those schools need to
put compliance plans in place.
Did Bob also agree that if a school stops claiming until they have their plan in
place they will not be at risk of sanction?
We all know a lot of folks can not get their plans in place by 12/31/2009.
Particularly those who haven't been told they need one.
It would also be helpful if the State could provide some guidance as to what the
new rates/fees will be. The question is will the new amounts make up for the
cost increases of the last decade and a half?
If they do then the revenue that will be received by most district could easily
double from what has been received in the past. If districts are not aware of
this they will not be aware that they need a plan.

No email reply, but Bob Hussar called me about this.
The bottom line according to Bob is if you "REASONABLY EXPECT" to claim $500,000
in the next 6 to 12 months you should have a compliance plan in place/certified
by 12/31.

Currently there are a large number of schools that are in an awkward position.
These schools either typically fall short of $500,000 or have not claimed over
$500,000 recently. Once claiming resumes, due to back billing, new rate
structures... they will claim over $500,000.
If a school WILL go over $500,000 at some point in the future, are they
mandated to have a plan in place now? Does the Dec. 31st date apply to
them?
I have been advising that it is a good idea for everyone to have a plan and that
if they go over $500,000 the are mandated to.
